By using this web site to participate in the Mrs Baird’s Get Your Grillin’ Gear program (the “Program”), you agree to these terms and conditions. If you do not agree to these Terms and Conditions, please do not use this web site or attempt to participate in the Get Your Grillin’ Gear program.

Bimbo Bakeries USA, Inc. (the "Company") reserves the right to change any feature of the Get Your Grillin’ Gear program at any time including, without limitation: the specific reward offer, the number Mrs Baird’s product purchases required to receive the reward, and the redemption requirements including shipping and handling costs. The Company also may cancel, terminate, or temporarily suspend the Program at any time without written notice. Please check these Terms and Conditions periodically for changes. Your use of the Get Your Grillin’ Gear section of the MrsBairds.com web site means you accept these Terms and Conditions and any changes that occur to them.

Please keep the following terms and conditions in mind:

The Offer

Upon proof of purchase of any six of the Mrs Baird’s products listed below, the customer may receive a Get Your Grillin’ Gear set when they pay $12.00 for shipping and handling. Proof of purchase and shipping and handling payment must be handled online via the Get Your Grillin’ Gear portion of the MrsBairds.com web site.

The 6-piece Grillin’ Gear set contains a:

  • 12-inch metal Spatula,
  • Tongs,
  • Fork,
  • Knife,
  • 9-inch heat resistant Grill Mitt, and a
  • Blue cotton blend tied Apron with the special Mrs Baird’s 100th Anniversary logo.   

Unless otherwise noted, all items are branded with the Mrs Baird’s logo.

No changes or substitutions are available for any item in the Grillin’ Gear set.

Included Mrs Baird’s Products

Proof of purchase of any of the products listed below in their specially marked packages is acceptable for this Program. No other products, including other Mrs Baird’s products will be accepted. Products must be specially marked packages to be accepted. If requested, the customer must produce the original, packages to receive the reward.

Program Start and End

The Mrs Baird’s Get Your Grillin’ Gear program begins on May 12, 2008 and ends on August 11, 2008. Only products purchased within this date range will be accepted and all reward claims must be submitted online between 12:01 a.m. May 12, 2008 and 11:59 p.m. August 11, 2008. Submissions made before or after this time and date range will not be accepted and the customer will not be notified.

Unique Codes

Each specially-marked package of the Mrs Baird’s products included in this Program will carry a unique product code on its packaging which may be used as proof of purchase of that product. To prove purchase, the customer must enter the unique product code from six of the included products in an online form.

Each unique code may be used only once. Only product codes, authorized by the Company and collected from packaging purchased at retail, are valid and will be accepted into the Program. No mechanical reproductions accepted.

Fraudulent submissions will be investigated and voided. In the event of fraud, abuse of privileges, or violation of the Program terms, the Company reserves the right to deny participation at any time and to pursue all available legal recourse.

Claiming the Reward

To claim the reward, the customer must enter their name, address, city, state, zip, and valid e-mail address, along with the six unique product codes. Following acceptance of this information, the customer must complete their credit card information, including the name on the credit card, the type of credit card being used, the credit card number, the month and year on which the credit card expires and the credit card security code.

When completed and accepted, the customer credit card will be charged the $12.00 shipping and handling fee and the Grillin’ Gear will be shipped via FedEx Ground.

Only VISA and MasterCard credit cards will be accepted for the shipping and handling fee. No debit cards, personal checks, money orders, cash or any other forms of payment will be accepted.

No changes will be allowed in the shipping carrier or method.

Other Terms

This program and its offerings are void where prohibited, taxed or otherwise restricted.

The Grillin’ Gear set reward merchandise is available in limited quantity. All rewards are subject to product availability. We reserve the right to substitute items of equal or greater value. We reserve the right to modify or cancel any reward at any time.

Merchandise will not be delivered to P.O., A.P.O. or F.P.O boxes. Deliveries made only in the 50 United States (not to Puerto Rico, U.S. Virgin Islands or other territories). Allow 4-6 weeks for delivery.  Participants take title to the reward merchandise upon shipment.  Participants agree that Company will not be liable for any lost stolen or otherwise misplaced reward merchandise after shipment.

Grillin’ Gear merchandise is not refundable, exchangeable, replaceable, redeemable or transferable for cash, credit, or other rewards under any circumstances. Merchandise is provided on an “as is” basis. The Company makes no representation or warranty of any kind with respect to reward merchandise, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

All rewards merchandise redeemed from the Program are made pursuant to a shipment contract with a third-party shipping carrier. This means that the risk of loss and title for such items pass to you upon our delivery to the shipping carrier.

Reward merchandise may not be returned or exchanged unless proven to be damaged or defective. Damaged or defective items must be returned within thirty (30) days of delivery. Products must be in their original packaging.

You agree to hold the Company, its parent, affiliates, partners and agencies harmless for any direct, indirect or consequential damages resulting from participation in the Program, any use of the reward merchandise, and receiving email messages or otherwise being contacted on behalf of the Program. You represent that you are the authorized user of the email address that you supply in the online form and are authorized to join Internet programs in which email communications are used, and are 18 years of age or older.

You must provide true and complete information in the online submission. In instances where we find that false or misleading information has been supplied, the Company reserves the right to ban the individual supplying the information from further participation in the Program.

It is your sole responsibility to ensure that the email address you initially provide is deliverable during the period of the Program.

APPLICABLE LAW

By visiting this web site and participating in the Program, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and the Company, its partners and agencies.

The Company reserves the right, at their sole discretion, to cancel, terminate, or suspend this Program should one or more computer viruses, malicious computer code, non-authorized human intervention, or other causes beyond their control, corrupt or affect the administration, security, fairness or proper conduct of the Program.

The Company, its parent, affiliates, partners and agencies are not responsible for typographical or other errors in these Terms and Conditions, the offering or the administration of the Program.
